चैक बाउंस के आरोपी को एक साल का कारावास

शिवपुरी। जिला कोर्ट के जेएमएफसी जितेन्द्र मेहर ने चैक बाउंस के मामले में एक शासकीय कर्मचारी को दोषी मानते हुए उसे एक साल का कारावास व ५ लाख २६ हजार रुपए प्रतिकर जमा करने के आदेश किए है। मामले में पीडि़त पक्ष से पैरवी एडवोकेट भरत ओझा ने की।
अभियोजन के मुताबिक शहर के ठकुरपुरा में हॉस्टल के पास रहने वाले शासकीय कर्मचारी परमानंद पुत्र हरूआ परिहार ने अपनी पारिवारिक जरूरत के लिए शिवपुरी निवासी रामेश्वर यादव से दो बार में ४ लाख रुपए तीन माह के लिए उधार लिए थे। बदले में एक चैक परमानंद ने रामेश्वर को दिया था। तीन माह बाद जब रामेश्वर ने परमानंद का चैक बैंक में लगाया तो वह बाउंस हो गया। बाद में रामेश्वर ने परेशान होकर कोर्ट की शरण ली और कोर्ट ने दोनो पक्षों की दलीले सुननें के बाद आरोपी परमानंद को दोषी माना और उसे एक साल कैद व ५ लाख २६ हजार रुपए का प्रतिकर देने की सजा सुनाई है। प्रकरण में आरोपी ने यह बचाव लिया था कि उक्त चैक उसने रवि यादव को दिया था और उसने अपने रिश्तेदार रामेश्वर के माध्यम से चैक का झूठा दावा लगाया है, पर कोर्ट ने इस बात को नही माना।

Shivpuri. District Court’s JMFC Jitendra Mehar held a government employee guilty in the case of cheque bounce and ordered him to be imprisoned for one year and to pay compensation of Rs. 5 lakh 26 thousand. Advocate Bharat Ojha represented the victim in the case.
According to the prosecution, government employee Parmanand son of Harua Parihar living near the hostel in Thakurpura of the city had borrowed Rs. 4 lakh in two installments for three months from Shivpuri resident Rameshwar Yadav for his family needs. In return, Parmanand gave a cheque to Rameshwar. After three months, when Rameshwar deposited Parmanand’s cheque in the bank, it bounced. Later, Rameshwar, upset, went to the court and after hearing the arguments of both the parties, the court held the accused Parmanand guilty and sentenced him to one year imprisonment and to pay compensation of Rs 5 lakh 26 thousand. In this case, the accused had taken the defense that he had given the said cheque to Ravi Yadav and he had made a false claim for the cheque through his relative Rameshwar, but the court did not accept this.
